General Terms and Conditions of Flowcreators - Noah Kempf

§1 Scope and Definitions (applicable to entrepreneurs and consumers)

(1) The following Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

§2 Conclusion of the Contract and Storage of the Contract Text

(1) The following regulations regarding contract formation apply to orders placed via our online shop at https://noahkempf.com/.

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer, but rather a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to enter into a purchase contract.
(4) Upon receipt of an order in our online shop, the following rules apply: The consumer submits a binding contractual offer by successfully completing the order process in our online shop.

The order process includes the following steps:

Before submitting the order bindingly, the consumer can go back to the page on which the customer’s information was input and correct input errors using the “Back” button in their internet browser or cancel the order process by closing the browser.
We confirm receipt of the order immediately via an automatically generated email (“Order Confirmation”). This email confirms our acceptance of your offer.

(5) Storage of the contract text for orders via our online shop: We send the order data and our Terms and Conditions via email. You can access the Terms and Conditions at any time at https://noahkempf.com/allgemeine-geschäftsbedingungen/.
Your order data will no longer be accessible via the Internet for security reasons.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The indicated prices include statutory VAT and other price components. Shipping costs may apply.

(2) The consumer can pay via bank transfer, PayPal, or credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will occur within 5 business days at the latest. The delivery period begins the day after the payment instruction is issued to the transferring bank in the case of advance payment, and on the day after conclusion of the contract for all other payment methods. If the deadline falls on a Saturday, Sunday, or public holiday at the delivery location, the deadline will be extended to the next working day.

(2) The risk of accidental loss and deterioration of the sold goods passes to the buyer only upon delivery.

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.

Consumers have the right to withdraw from this contract within the following terms. A consumer is any natural person who concludes a legal transaction for purposes not primarily related to their trade, business, or profession.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us at:
by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different delivery method than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received your notice of withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise. You will not be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods to us immediately and in any event not later than fourteen days from the day on which you notify us of the withdrawal. The deadline is met if you send back the goods before the fourteen-day period has expired.

You will bear the direct cost of returning the goods.
